Tribes with Potential Consultation Interests in Kansas
The Section 106 process, as implemented by 36 CFR Part 800, requires that federal agencies consult with any Native American tribe that attaches religious and/or cultural significance to historic properties that may be affected by federal undertakings (36 CFR 800.2 (c)(3)). The Agency Official must provide the Native American tribe a reasonable opportunity to identify and evaluate its concerns about historic properties, articulate its views on the potential effects to such properties by the undertaking, and participate in the resolution of any adverse effects (36 CFR 800.2 (c)(3)(I)).
The Kansas State Historic Preservation Office maintains the following listing of tribes with consultation interests in the state as a courtesy for consultants and agencies. Since the listing is not comprehensive, it is strongly recommended that consultants refer to other sources for Tribal Consultation information, including the Tribal Directory Assessment Tool (HUD), the National Park Service THPO listings, as well as the various resources found on the National Park Service's website.
36 CFR 800.3 (f)(2) states that the Agency Official shall make a reasonable and good faith effort to identify any Indian tribe or Native Hawaiian organizations that might attach religious and cultural significance to historic properties in the area of potential effect and invite them to be consulting parties. Therefore, in addition to consulting the databases listed above (which should not be considered exhaustive), Agency Officials should consult those additional web sites recommended therein for further assistance.

Native American Tribes Consultation Addresses
Provided below is a list of addresses for the Native American tribes with potential consultation interests in undertakings in the state of Kansas that are subject to the Section 106 process. To the best of our knowledge, these addresses are correct and up-to-date, but this list will continue to be updated as necessary. If you find any of these addresses to be in error, please contact Austin Main, Kansas State Historic Preservation Office Archeologist.
With reference to the consultation process, the Advisory Council states that unlike situations where the regulations specify a 30-day review period for certain findings and determinations, there is no formal "clock" on consultation. Federal agencies are expected to provide reasonable time for other consulting parties to respond to requests for consultation. Likewise, each consulting party is expected to be responsive and to act in a timely fashion. If an Agency Official believes that a consulting party is being unresponsive, the Agency Official should make a reasonable effort to get the party to respond and then document that effort before moving ahead in the process. Failure of a consulting party to provide views does not mean that the Agency Official can assume that party's concurrence with a particular view or position, but does not prohibit the Agency Official from moving forward in the Section 106 review.
In order to document efforts to contact identified consulting parties, the Kansas State Historic Preservation Office advises that the Agency Official first attempt contact via certified mail. If the consulting party does not respond to the certified letter, we advise that the Agency Official then call the consulting party and document that effort. It is our opinion that such an approach represents a reasonable and good faith effort to contact all identified consulting parties before advancing the Section 106 review process.
